Purpose of this Notice

The purpose of this Privacy Policy (“Privacy Policy”) is to inform you of how AllianceHCM (“Alliance,” “we,” “us,” or “our”) protects and uses your personal information when accessing and using: (a) the website alliancehcm.com (the “Website”), including any portals related to administrators, managers, employees, and SwipeClock; (b) the All Pay website and mobile application at hralliance.net (the “All Pay Services”); and (c) the MyPay website and mobile application at hralliance.net, available on Google Play and Apple App Store (the “MyPay Services”) (collectively with the Website, the “Services”). We are committed to respecting your privacy rights. Please read this Privacy Policy carefully. It gives you important information about how we handle your personal information.

This Privacy Policy is effective as of the date first listed above and has been developed with the recognition that applicable laws regarding privacy and personally identifying information, and the dissemination thereof, are evolving. Accordingly, this Privacy Policy is subject to change at any time and Alliance expressly reserves the right to modify the terms of this Privacy Policy at any time and in our reasonable discretion. Your continued use of the Services that link to this Privacy Policy following our posting of a change notice will constitute binding acceptance of this Privacy Policy and all changes thereto.

This Privacy Policy provides you with a notice of our privacy policies and practices informing you of the types of information that we collect from you and the persons or entities to whom your personal information may be disclosed. This Privacy Policy does not apply to Alliance’s activities as a consumer reporting agency, whether through the Services or otherwise.

Information We Collect 

In the course of your use of the Services, you may voluntarily share information about yourself, for example, such as through the “Contact Us” form on our Website, when registering for the All Pay Services, or when using the MyPay Services.

Following are the categories of personal information we may collect from you when you share it with us:

  • Identifiers (e.g., name, address, company, phone number, email address, internet protocol address, other similar identifiers)
  • Commercial information (e.g., interest in specific Alliance products and services, other similar information)
  • Internet or other electronic network activity information (e.g., internet protocol address, browser type, cookies used for identification, and information regarding a consumer’s interaction with the Services)

When you visit the Services, we also collect technical and usage information that does not identify you personally, including information about your Internet service provider, the date and time you access the Services, the Internet address of websites from which you linked to our Services, the type of device, browser and operating system you are using, and your movements and preferences on our Services.

Client Data

We receive nonpublic personal data from or on behalf of our clients (employers) and their personnel regarding their personnel and their personnel’s dependents and family members. Such information is required for us to effectively provide our services to our clients, and may include social security numbers, payroll information, tax information, and other information our clients may provide in order for us to perform our services (collectively, “Client Data”). We use at least industry standard security policies and measures to help prevent any unauthorized access to Client Data. We process, use, and share Client Data as instructed or permitted by the applicable client. We may transmit Client Data as necessary for providing our services in accordance with our standard business practices and this Privacy Policy, but we will maintain reasonable security policies regardless of where Client Data is stored or processed.

We will share any Client Data with the client and any third parties, as instructed by the client, permitted by the client, or to facilitate services to the client or its employees. We may also share Client Data with other third-party data processors who facilitate our provision of the services requested by the client and who are prohibited from using Client Data except for such purpose. We may also be required to share Client Data with applicable government entities (for example, the IRS, state tax agencies, and entities who participate in the NACHA program for funds transfer purposes) or as otherwise required by law.

If you are one of our clients’ personnel, or the dependent or family member of one of our clients’ personnel, and you have any questions or concerns regarding your personal data or your privacy rights, or you would like to access or correct your personal data, please contact your employer.

Use of Personal Information

We may use personal information to contact you in response to your inquiries, comments and suggestions; for the specific purpose for which it was volunteered (for example, to receive or set-up Alliance products or services); to track our visitors’ use of the Services for internal market research; to improve the Services and the products and services we promote or provide through the Services or through other means; to customize the content and/or layout of our Services for each individual visitor; to notify visitors about updates to the Services or services; to notify you about promotions, special offers, etc., regarding products and services provided by Alliance; as required by law or regulation, or as requested by government authorities; for our internal business purposes or to otherwise manage your relationship with Alliance.

You may choose to opt out of receiving future marketing or promotional email messages from us. Each such email (excluding non-promotional communications, such as those responding to your specific inquiries or related to your relationship with us) sent by us contains an “unsubscribe,” “opt- out”, or similar link with instructions on how to remove yourself from the applicable email list. Additionally, we may always email you in response to your correspondence or in connection with any other transactions you have with us.

We may use other information, which does not identify you personally, for any reason we deem appropriate, including for purposes of administering, protecting and improving our Services and systems, to better understand the preferences of our Services visitors, to identify server problems, to compile aggregated statistics about Services usage, and to help personalize your experience on our Services.

Sharing Personal Information

We do not sell your personal information to third parties or share your personal information to third parties for their marketing or advertising purposes.

We may transfer or subprocess personal information: to our service providers (such as our customer support specialists, email campaign providers, payment processors, etc.), who are only permitted to use the information to provide services to us and you; as required by law or legal proceeding or to protect our or others’ legal rights; and in connection with an acquisition, merger, sale, or other transfer of all or any portion of our business. 

We may share other information (which does not identify you personally) with any party for any purpose we deem appropriate.

We have disclosed for a business purpose to one or more third parties the following categories of personal information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a consumer:

Cookies

In order to personalize and enhance your experience on our Services, we also may collect information through “cookies.” Cookies are small strings of text sent by our Services to your browser and then stored by your browser on your computer’s hard drive. Our cookies allow us to not only personalize your experience on our Services, make your visit more convenient, and understand how you and others are using our Services so we can improve your experience on the Services. We use cookies to identify repeat visitors to our Services and to determine the paths visitors take on our Services. Additionally, we use certain advertisement networks (such as Meta Platforms, Inc and Google LLC that use retargeting cookies to collect certain information about you (including the pages and content you view, the date and time of such views, and location information associated with your IP address).

Some browsers and browser extensions support the Global Privacy Control (“GPC”) that can send a signal to process your request to opt out from certain types of data processing. Third-Party Analytics Services

We use Google Analytics to better understand the behavior of visitors to our Services. This includes anonymized data associated with your IP address, such as pages viewed on the Services, length of time on the Services, browser used to access the Services, and device used to access the Services. The information collected does not personally or directly identify you or your street address. Mobile Application Data Collection

Our mobile applications also may access metadata and other information associated with other files stored on your device to the extent you choose to upload this information. This may include, for example, photographs uploaded to the mobile application. . You may opt out of this data collection in your mobile device’s settings. However, opting out may interfere with the application’s functionality.

Data Retention 

We will retain your personal information and non-personal information for as long as it is reasonably necessary to fulfill the purpose for which it was given. Different retention periods apply for different types of personal information based on the purpose for which it was gathered.

We reserve the right to dispose of or delete any or all such personal information or non-personal information at any time (including prior to any specific retention timeframe we may communicate), except as set forth in any other agreement or document executed by both you and us concerning the same or as required by law.

  • The right to data portability. You may have right to request your personal information in a format that is portable and useable.
  • The right to deletion. You may have the right to request that we delete the personal information that we have collected or maintain about you. We may deny your request under certain circumstances, such as if we need to comply with our legal obligations or complete a transaction for which your personal information was collected. If we deny your request for deletion, we will let you know the reason why.

We do not engage in or have features that engage in automated decision-making. If this changes, we will update our Policy accordingly.

The Services are not directed at or intended to be used by children, and Alliance will not intentionally collect or maintain personal information about anyone under the age of 16, except for information provided by the relevant parent(s) or guardian(s). If we discover that we have collected any other personal information about anyone under the age of 16, we will take reasonable steps to promptly delete such information from our systems.

By opting into SMS from a web form or other medium, you are agreeing to receive SMS messages from Alliance Payroll Services LLC. This includes SMS messages for appointment scheduling, appointment reminders, support request responses, billing notifications, and processing notifications. Message frequency varies.
